To whom it may concern,
I would like to inform you about current situation of match fixing case that you're already aware with previous UEFA and CAS Court decisions.
On january 17th , Turkish High Court of Appeal finalised the match fixing case and appealed many clubs and their involved sportsman , particularly Aziz Yıldırım , president of Fenerbahce club guilty of charges as match fixingin 5 games and being leader of the regarding crime organisation.
We all know UEFA is watching the case to be concluded by turkish courts in order to finally act on local penalties.However , Turkish Football Federation has declared that they wont change their decision and give any penalty to the involved clubs.Therefore common belief of turkish football fans is shakened that the federation won’t punish fenerbahce and other clubs guilty of match fixing , unless UEFA handles the case and forces the fedaration to prosecute the charges on Fenerbahce and other clubs involved in match fixing.
As clearly stated in Turkish FF, UEFA and FIFA’s Disciplinary rules that teams involved in match fixing must be relegate. See the decisions of various organisation regarding match fixer Fenerbahce SK below;
• On 02.07.2012 Turkish Court found them guilty of match fixing.
• On 10.06.2013 UEFA found them guilty of match fixing.
• On 22.06.2013 UEFA Disciplinary Body found them guilty of match fixing.
• On 15.07.2013 UEFA Appeals Body found them guilty of match fixing.
• On 28.08 2013 CAS found them guilty of match fixing.
According to the law regarding Turkish Football Federation’s establishment and Duties Article 3/c ;
‘Turkish Football Federation has to make sure the rules and regulations established by UEFA and FIFA are put in force as stated…’
According to the Turkish Football Federation Status Article 2/f ;
‘Turkish Football Federation has to obey the verdicts of UEFA and FIFA and make sure all parties, such as; clubs, players, managers, etc, obey these verdicts too…’
According to the Turkish Football Federation Disciplinary Code 55/1(b) ;
‘Teams, whose board members are involved in match fixing or bribery, must be relegated to a lower division’
According to the UEFA Statutes (Edition 2012) ;
Article 7:
(1) [Fair Play, Statutes, Laws of the Game]:
“ Member Associations shall have the following obligations:
a) to observe the principles of loyalty, integrity and sportsmanship in accordance with the principles of fair play; […]
Member Associations shall include these obligations in their statutes, as well as a provision that leagues, clubs, players and officials shall observe these obligations.”
According to the FIFA Disciplinary Code 70 / 2 ;
‘The judicial bodies of FIFA reserve the right to sanction serious infringements of the statutory objectives of FIFA (cf. fi nal part of art. 2) if associations, confederations and other sports organisations fail to prosecute serious infringements or fail to prosecute in compliance with the fundamental principles of law.’
Most annoyingly Fenerbahce Club administration declared that "They're proud of being member of the crime organisation led by Aziz Yıldırım and they won't recognise Turkish High Court of Appeal's final decision nor UEFA , CAS courts." This is unbeleivably a mocking act towards both Turkish Courts and UEFA!
Turkish football has been damaged severely due to the fact that neither TFF nor government is willing to take act against this match fixing organisation.Fairplay and faith of sport fans is compromised.
We ask you to urge turkey football federation to do their job properly and penalise the involved clubs and people according to the laws and disciplinary code above.
We want justice, clear football which isn't involved in any match-fixing.
